Intially the case against illegal use of this “passive weapon” and excessive force was lost, but Smallman appealled and won the second round. The Swiss authorities then appealled the appeal. The decision on the second appeal is due tomorrow, Friday 20 November 2009.
If the court decision falls on the state side, Smallman will end up paying massive costs to the Swiss courts. In no lesser words, this well known and highly acclaimed photojournalist will end up paying the Swiss authorites for blowing off the back back of his leg.
